Forex brokers met een vergunning van de Cyprus Securities and Exchange Commission (CySEC) opereren binnen het Europese regelgevingskader.<\/p>\n<p>CySEC-gereguleerde Forex brokers staan onder toezicht van de Cypriotische toezichthouder en moeten voldoen aan Europese regels voor onder meer beleggersbescherming, risicobeheer en transparantie. \t\t\t<\/div>\n    \t\t\n<p>In dit artikel gaan we nader in op CySEC-gereguleerde Forex brokers en de mogelijke voordelen van handelen via deze partijen. Ook bespreken we de vergunningsvoorwaarden en kosten, hoe u de geldigheid van een vergunning controleert, welke hefboomlimieten gelden en welke fiscale aandachtspunten er zijn. Het artikel is bedoeld voor zowel ervaren handelaren als beginners die overwegen via een CySEC-gereguleerde broker te handelen.<\/p>\n<h2 id=\"history\">Geschiedenis en overzicht van CySEC<\/h2>\n<p>CySEC werd in 2001 opgericht om toezicht te houden op de Cypriotische markt voor beleggingsdiensten en effecten. Na de toetreding van Cyprus tot de Europese Unie werd het toezichtskader verder afgestemd op de geldende Europese regels voor veiligheid, transparantie en beleggersbescherming.<\/p>\n<p>In de beginjaren hield CySEC toezicht op een relatief klein aantal financi\u00eble instellingen. Naarmate de financi\u00eble sector van Cyprus groeide, namen ook de rol en verantwoordelijkheden van de toezichthouder toe. Tegenwoordig houdt CySEC toezicht op een groot aantal beleggingsondernemingen en andere gereguleerde marktpartijen. De toezichthouder speelt daarmee een belangrijke rol voor brokers die vanuit Cyprus actief zijn in andere EU-lidstaten.<\/p>\n<p>CySEC is verantwoordelijk voor het verlenen van vergunningen aan onder meer beleggingsondernemingen, fondsbeheerders en bepaalde andere partijen op de effectenmarkt. De toezichthouder controleert of vergunninghouders voldoen aan de Cypriotische en Europese regelgeving. Tot haar taken behoren daarnaast het bewaken van de marktintegriteit en het beschermen van beleggers tegen onrechtmatig marktgedrag.<\/p>\n<p>CySEC publiceert vergunninggegevens, waarschuwingen, sancties en andere toezichtsinformatie. Voor beleggers blijft het belangrijk niet alleen naar het bestaan van een vergunning te kijken, maar ook te controleren welke juridische entiteit de dienstverlening aanbiedt en voor welke diensten zij daadwerkelijk toestemming heeft.<\/p>\n<h2 id=\"licensing\">Licentievoorwaarden en kosten<\/h2>\n<p>Het vergunningsproces van CySEC is bedoeld om vast te stellen of een financi\u00eble instelling aan de wettelijke eisen voor beleggingsondernemingen voldoet. Om een CySEC-vergunning te verkrijgen en te behouden, moet een onderneming onder meer aan de volgende voorwaarden voldoen:<\/p>\n<ol>\n<li><strong>Kosten:<\/strong> De onderneming moet de toepasselijke aanvraag- en toezichtkosten betalen.<\/li>\n<li><strong>Minimumkapitaal:<\/strong> Afhankelijk van de toegestane diensten geldt in beginsel een minimumkapitaal van \u20ac 75.000, \u20ac 150.000 of \u20ac 750.000. De hoogste kapitaaleis geldt onder meer voor bepaalde vormen van handel voor eigen rekening.<\/li>\n<li><strong>Lokale aanwezigheid:<\/strong> De onderneming moet haar statutaire zetel en feitelijke leiding in Cyprus hebben en over voldoende lokale aanwezigheid beschikken.<\/li>\n<li><strong>Risicobeheer:<\/strong> De onderneming moet passende procedures voor risicobeheer, interne controle en naleving implementeren.<\/li>\n<li><strong>Bescherming van klantgelden:<\/strong> Klantgelden moeten van het eigen vermogen van de onderneming worden gescheiden. Voor aangesloten ondernemingen gelden daarnaast bijdragen aan het beleggerscompensatiefonds.<\/li>\n<li><strong>AML en KYC:<\/strong> Brokers moeten <a href=\"https:\/\/www.cysec.gov.cy\/en-GB\/legislation\/financial-crimes\/\" rel=\"noopener nofollow\" target=\"_blank\">anti-witwas (AML)<\/a> en ken-uw-klantprocedures (KYC) implementeren om financi\u00eble criminaliteit tegen te gaan en klanten correct te identificeren en verifi\u00ebren.<\/li>\n<\/ol>\n<p>De aanvraagkosten voor een CySEC-vergunning hangen af van de aangevraagde beleggingsdiensten en activiteiten. Daarnaast betalen vergunninghouders periodieke toezichtkosten. De bedragen kunnen veranderen, waardoor de actuele tarieventabel van CySEC leidend is.<\/p>\n<p>Een andere belangrijke eis is de scheiding van klantgelden. Daarbij worden de tegoeden van klanten apart gehouden van het eigen vermogen van de financi\u00eble instelling. Het Investor Compensation Fund kan bij een aangesloten insolvente beleggingsonderneming dekking bieden aan in aanmerking komende klanten. De vergoeding bedraagt maximaal het laagste bedrag van 90% van de gedekte vordering of \u20ac 20.000 per klant.<\/p>\n<h2 id=\"legitimacy\">Hoe de legitimiteit van een licentie bevestigen<\/h2>\n<p>De meeste Forex brokers vermelden informatie over hun vergunningen op hun website. U kunt ook contact opnemen met de klantenservice van een broker en vragen naar de toezichtstatus. Vertrouw echter niet uitsluitend op informatie die de broker zelf verstrekt. Frauduleuze partijen kunnen ten onrechte beweren dat zij over een vergunning beschikken of misbruikmaken van de gegevens van een bestaande vergunninghouder.<\/p>\n<p>Om te controleren of een Forex broker een vergunning van CySEC heeft, moet u nagaan of de juridische entiteit achter de handelsnaam voorkomt in het offici\u00eble register van CySEC. Controleer daarbij niet alleen de naam, maar ook het vergunningsnummer, het geregistreerde webdomein en de toegestane diensten. Dat doet u als volgt:<\/p>\n<ul class=\"list\">\n<li><strong><a href=\"https:\/\/www.cysec.gov.cy\/en-GB\/home\/\" rel=\"noopener nofollow\" target=\"_blank\">Bezoek de CySEC-website<\/a>:<\/strong> Ga naar de offici\u00eble CySEC-website, waar u het register met geautoriseerde beleggingsondernemingen kunt raadplegen.<\/li>\n<li><strong><a href=\"https:\/\/www.cysec.gov.cy\/en-GB\/entities\/investment-firms\/\" rel=\"noopener nofollow\" target=\"_blank\">Controleer de lijst<\/a>:<\/strong> Zoek de juridische naam van de broker op in het register. U kunt zoeken op bedrijfsnaam, vergunningsnummer of categorie.<\/li>\n<li><strong>Verifieer het licentienummer en het domein van de broker:<\/strong> Controleer of het vergunningsnummer, de juridische entiteit en de geregistreerde domeinnamen overeenkomen met de broker die u onderzoekt.<\/li>\n<\/ul>\n<p>Door deze stappen te volgen, kunt u vaststellen of u daadwerkelijk handelt met de CySEC-vergunninghouder en niet met een onbevoegde partij die de naam of vergunningsgegevens van een andere onderneming gebruikt.<\/p>\n<h2 id=\"instruments\">Instrumentbeperkingen<\/h2>\n<p>Sommige toezichthouders beperken of verbieden bepaalde handelsinstrumenten. In de Verenigde Staten zijn CFD\u2019s bijvoorbeeld niet beschikbaar voor particuliere beleggers. Britse retailbeleggers hebben toegang tot veel CFD\u2019s, maar <a href=\"https:\/\/www.rationalfx.com\/nl\/crypto-brokers\/\">Cryptoderivaten<\/a>, waaronder CFD\u2019s op cryptovaluta, mogen daar niet aan hen worden aangeboden.<\/p>\n<p>In Nederland is de verkoop van binaire opties aan retailbeleggers verboden. Voor CFD\u2019s gelden onder meer hefboomlimieten, margin-close-out en bescherming tegen restschuld. MiCA geldt voor bepaalde cryptoactiva en cryptodiensten; crypto-CFD\u2019s vallen onder de regels voor financi\u00eble instrumenten.<\/p>\n<p>CySEC-vergunninghouders moeten rekening houden met Europese regels en met productinterventiemaatregelen in de lidstaat waar zij hun diensten aanbieden. Een CySEC-vergunning betekent daarom niet dat ieder instrument zonder beperking aan Nederlandse klanten mag worden aangeboden. Ongereguleerde entiteiten mogen Nederlandse of andere Europese beleggers niet actief benaderen voor vergunningplichtige beleggingsdiensten.<\/p>\n<h2 id=\"leverage-limits\">Leverage-limieten<\/h2>\n<p>Wanneer u handelt via een door CySEC gereguleerde broker, is het belangrijk dat u de geldende hefboomlimieten en de risico\u2019s van handelen met een hefboom begrijpt. De productinterventiemaatregelen van de <a href=\"https:\/\/www.esma.europa.eu\/\" rel=\"noopener nofollow\" target=\"_blank\">Europese Autoriteit voor Effecten en Markten<\/a> (ESMA) vormden de basis voor nationale beperkingen die particuliere beleggers moeten beschermen tegen buitensporige risico\u2019s en verliezen.<\/p>\n<p>Als particuliere belegger in Europa kunt u voor grote valutaparen handelen met een <a href=\"https:\/\/www.rationalfx.com\/nl\/forex-brokers\/leverage-1-30-forex-brokers\/\">maximale leverage van 1:30<\/a>. Voor overige valutaparen, waaronder minor en exotische valutaparen, geldt doorgaans een maximum van 1:20. Deze limieten gelden voor retailbeleggers, ongeacht hun handelservaring of risicobereidheid. <a href=\"https:\/\/www.rationalfx.com\/nl\/forex-brokers\/pro-account-forex-brokers\/\">professionele handelaren<\/a> kunnen, als zij aan de classificatiecriteria voldoen, toegang krijgen tot een hogere hefboom. Het beschikbare niveau verschilt per broker en bepaalde beschermingsmaatregelen voor retailbeleggers vervallen bij een professionele classificatie.<\/p>\n<p>Een hoge hefboom vergroot zowel potenti\u00eble winsten als verliezen. Zelfs kleine marktbewegingen kunnen daardoor snel tot aanzienlijke verliezen en het automatisch sluiten van posities leiden. Voor particuliere CFD-rekeningen geldt bescherming tegen een negatief saldo: uw totale aansprakelijkheid voor CFD\u2019s is beperkt tot het geld dat aan de betreffende CFD-rekening is toegewezen. U kunt dat saldo echter wel volledig verliezen.<\/p>\n<p>Voordat u een hefboom gebruikt, is het verstandig uw kennis, ervaring en risicobereidheid realistisch te beoordelen. Houd daarnaast uw vrije marge en rekeningwaarde in de gaten.
