Ook bespreken we de vereisten voor <a href=\"https:\/\/www.rationalfx.com\/nl\/forex-brokers\/\">Forex brokers<\/a>, aandachtspunten bij het beoordelen van brokers en de mogelijke fiscale gevolgen van Forexhandel in Nederland.<\/p>\n<h2 id=\"legal\">Juridische vormen van Forexhandel in Nederland<\/h2>\n<p>De AFM houdt in Nederland gedragstoezicht op de financi\u00eble markten. Een broker met een Nederlandse vergunning staat rechtstreeks onder toezicht van de AFM. Een broker uit een ander EER-land kan diensten aanbieden via een Europees paspoort en blijft dan in beginsel onder toezicht van de toezichthouder in het land van herkomst. Nederland valt daarnaast onder de richtsnoeren van <a href=\"https:\/\/www.esma.europa.eu\/\" rel=\"noopener nofollow\" target=\"_blank\">ESMA<\/a> en de <a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2014\/65\/oj\/eng\" rel=\"noopener nofollow\" target=\"_blank\">MiFID II<\/a>-richtlijn, die onder meer transparantie en beleggersbescherming bevorderen. Veelvoorkomende vormen van valutahandel zijn:<\/p>\n<ol>\n<li><strong>Spothandel: <\/strong>de directe aankoop en verkoop van valuta tegen de actuele marktprijs. Dit moet worden onderscheiden van doorlopende, met hefboom verhandelde spot-Forexproducten, die voor particuliere cli\u00ebnten doorgaans als CFD worden aangeboden.<\/li>\n<li><strong>CFD&#8217;s (Contract for Difference): <\/strong>derivaten waarmee handelaren kunnen speculeren op prijsbewegingen van valuta zonder de onderliggende valuta te bezitten. <a href=\"https:\/\/www.rationalfx.com\/nl\/cfd-brokers\/\">Brokers die CFD-handel aanbieden<\/a> aan particuliere cli\u00ebnten moeten de toepasselijke beschermingsmaatregelen naleven.<\/li>\n<li><strong>Spread betting op valutaparen:<\/strong> spread betting is vooral bekend uit het Verenigd Koninkrijk en is geen gangbaar Nederlands beleggingsproduct. Buitenlandse fiscale voordelen gelden niet automatisch in Nederland. Controleer vooraf of en onder welke vergunning een aanbieder dit product aan Nederlandse cli\u00ebnten mag aanbieden.<\/li>\n<li><strong>Futures:<\/strong> valutafutures zijn gestandaardiseerde derivaten waarmee een valutapaar tegen een vooraf bepaalde wisselkoers en op een vastgestelde toekomstige datum kan worden gekocht of verkocht.<\/li>\n<li><strong>Forwards: dit zijn over-the-counter (OTC)-instrumenten <\/strong>die de wisselkoers voor de aan- of verkoop van een valuta op een toekomstige datum vastleggen.<\/li>\n<\/ol>\n<p>Forexbrokers die Nederlandse cli\u00ebnten bedienen, moeten beschikken over de juiste vergunning of een geldig EER-paspoort en voldoen aan de regels die op hun diensten en producten van toepassing zijn.<\/p>\n<h2 id=\"restrictions\">Beperkingen bij valutahandel in Nederland<\/h2>\n<p>De AFM heeft productbeperkingen ingevoerd voor risicovolle handelsproducten. Sinds 19 april 2019 is het door de <a href=\"https:\/\/www.afm.nl\/en\/sector\/actueel\/2019\/apr\/binaire-opties-cfds-interventies\" rel=\"noopener nofollow \" target=\"_blank\">AFM de verkoop van binaire opties<\/a> aan particuliere beleggers in of vanuit Nederland verboden. Deze nationale maatregel volgde op tijdelijke EU-brede maatregelen van ESMA uit 2018. Voor CFD&#8217;s gelden onder meer hefboomlimieten, bescherming tegen een negatief saldo en verplichte risicowaarschuwingen. De AFM waarschuwt daarnaast voor handelen via aanbieders zonder de vereiste vergunning.<\/p>\n<p>Brokers moeten duidelijke en begrijpelijke informatie verstrekken over de kenmerken, risico&#8217;s en kosten van hun producten. Ook moeten zij beoordelen voor welke doelgroep een product bedoeld is en de toepasselijke regels voor particuliere cli\u00ebnten naleven.<\/p>\n<h2 id=\"regulator\">Wie reguleert Forexhandel in Nederland?<\/h2>\n<p>De <a href=\"https:\/\/www.afm.nl\/en\/over-de-afm\" rel=\"noopener nofollow \" target=\"_blank\">Autoriteit Financi\u00eble Markten<\/a> (AFM) is de belangrijkste gedragstoezichthouder voor Forex- en CFD-dienstverlening in Nederland. De belangrijkste doelstellingen van de AFM zijn:<\/p>\n<ul class=\"list\">\n<li>Consumenten en beleggers beschermen door toe te zien op een eerlijke, zorgvuldige en transparante dienstverlening.<\/li>\n<li>Bijdragen aan ordelijke en transparante financi\u00eble markten.<\/li>\n<li>De integriteit van de financi\u00eble markten en het vertrouwen daarin bevorderen.<\/li>\n<\/ul>\n<p>De AFM heeft een reeks bevoegdheden en verantwoordelijkheden, waaronder:<\/p>\n<ul class=\"list\">\n<li>Het verlenen van vergunningen aan en toezicht houden op Nederlandse financi\u00eble instellingen, waaronder beleggingsondernemingen die Forex- en CFD-diensten aanbieden.<\/li>\n<li>Het monitoren en handhaven van de naleving van financi\u00eble wet- en regelgeving.<\/li>\n<li>Het onderzoeken van overtredingen en het opleggen van bestuursrechtelijke maatregelen, zoals boetes en lasten onder dwangsom.<\/li>\n<li>Het verstrekken van informatie en waarschuwingen aan consumenten en beleggers.<\/li>\n<\/ul>\n<p>Naast het Nederlandse toezicht valt Forexhandel onder Europese regelgeving, waaronder MiFID II en MiFIR. ESMA bevordert consistente toepassing van deze regels binnen de EU en stelt richtsnoeren en technische standaarden op voor onder meer beleggersbescherming en marktintegriteit.<\/p>\n<p>Binnen het Nederlandse toezichtmodel richt de AFM zich op gedragstoezicht, terwijl <a href=\"https:\/\/www.dnb.nl\/en\/\" rel=\"noopener nofollow \" target=\"_blank\">De Nederlandsche Bank<\/a> (DNB) waar van toepassing prudentieel toezicht houdt op de financi\u00eble soliditeit van instellingen. De <a href=\"https:\/\/www.ecb.europa.eu\/\" rel=\"noopener nofollow \" target=\"_blank\">Europese Centrale Bank<\/a> (ECB) speelt vooral een rol bij het prudenti\u00eble toezicht op banken. Biedt een broker daarnaast afzonderlijke cryptodiensten aan, dan kan MiCAR daarop van toepassing zijn; gewone Forex- en CFD-diensten blijven onder het effectenrecht vallen.<\/p>\n<p>U kunt in het AFM-register controleren of de juridische entiteit van een broker beschikt over een AFM-vergunning, een relevante DNB-vergunning of een inkomend EER-paspoort. De toezichthouder publiceert hiervoor een <a href=\"https:\/\/www.afm.nl\/en\/sector\/registers\/vergunningenregisters\" rel=\"noopener nofollow \" target=\"_blank\">lijst van vergunde brokers<\/a> en andere geregistreerde financi\u00eble ondernemingen. Een vermelding in het register is geen kwaliteitskeurmerk; controleer ook de exacte handelsnaam, website en toezichthouder in het land van herkomst.<\/p>\n<h2 id=\"requirements\">Vereisten voor Forex brokers in Nederland<\/h2>\n<p>Afhankelijk van de juridische entiteit en de aangeboden producten moeten Forexbrokers die Nederlandse cli\u00ebnten bedienen onder meer voldoen aan de volgende vereisten:<\/p>\n<ul class=\"list\">\n<li><strong>Bescherming tegen een negatief saldo: <\/strong>bij particuliere CFD-rekeningen moet de totale aansprakelijkheid beperkt blijven tot het beschikbare geld op de CFD-rekening.<\/li>\n<li><strong>Hefboomlimieten voor particuliere cli\u00ebnten: <\/strong>voor particuliere CFD-cli\u00ebnten geldt dat de maximale toegestane <a href=\"https:\/\/www.rationalfx.com\/nl\/forex-brokers\/leverage-1-30-forex-brokers\/\">hefboom is 1:30 voor belangrijke valutaparen<\/a> en 1:20 voor minder belangrijke valutaparen.<\/li>\n<li><strong>Beleggerscompensatie:<\/strong> compensatiestelsels kunnen bescherming bieden als een beleggingsonderneming door bijvoorbeeld faillissement geen cli\u00ebntgelden of financi\u00eble instrumenten kan teruggeven. Zij vergoeden geen handelsverliezen. Bij een EER-paspoort geldt doorgaans het stelsel van het land van herkomst.<\/li>\n<li><strong>Risicowaarschuwingen: <\/strong>brokers moeten duidelijke informatie geven over de risico&#8217;s van Forex- en CFD-handel, waaronder het percentage particuliere CFD-rekeningen dat verlies lijdt.<\/li>\n<li><strong>Scheiding van cli\u00ebntgelden:<\/strong> brokers moeten cli\u00ebntgelden en financi\u00eble instrumenten volgens de toepasselijke regels beschermen en gescheiden houden van het eigen vermogen.<\/li>\n<li><strong>Automatische margin close-out: <\/strong>bij particuliere CFD-rekeningen moeten posities worden gesloten wanneer het rekeningsaldo onder 50% van de totale vereiste initi\u00eble marge daalt.<\/li>\n<\/ul>\n<h2 id=\"identify\">Hoe betrouwbare Forex brokers te identificeren die Nederlandse cli\u00ebnten accepteren<\/h2>\n<p>U kunt Forexbrokers die Nederlandse cli\u00ebnten accepteren onder meer beoordelen aan de hand van de volgende punten:<\/p>\n<ul class=\"list\">\n<li><strong>AFM-vergunning of EER-paspoort:<\/strong> de juridische entiteit moet beschikken over een passende Nederlandse vergunning of een vergunning in een ander EER-land waarmee zij haar diensten rechtsgeldig in Nederland mag aanbieden.<\/li>\n<li><strong>Het register controleren:<\/strong> controleer in het AFM-register de exacte juridische naam, handelsnaam, toegestane diensten en toezichthouder in het land van herkomst.<\/li>\n<li><strong>Prijstransparantie:<\/strong> de broker moet duidelijke informatie verstrekken over spreads, commissies, financieringskosten, valutakosten en overige tarieven.<\/li>\n<li><strong>Reputatie:<\/strong> onderzoek de reputatie van de broker, maar beschouw online beoordelingen niet als vervanging voor een controle van vergunningen en offici\u00eble waarschuwingen.<\/li>\n<\/ul>\n<p>Wees voorzichtig met brokers die ongebruikelijk hoge hefbomen aanbieden, druk uitoefenen om snel geld te storten of uitzonderlijk hoge rendementen beloven. Dit kunnen signalen van fraude of dienstverlening zonder passende vergunning zijn. Zorgvuldig onderzoek kan bepaalde risico&#8217;s beperken, maar biedt geen garantie tegen handelsverliezen.<\/p>\n<h2 id=\"taxes\">Zijn er belastingen op winsten uit Forex trading in Nederland?<\/h2>\n<p>Nederland kent geen afzonderlijke vermogenswinstbelasting die automatisch over iedere gerealiseerde Forexwinst wordt geheven. Forexposities, rekeningtegoeden en daarmee samenhangende bezittingen of schulden kunnen, afhankelijk van hun juridische vorm en uw omstandigheden, tot box 3 behoren.<\/p>\n<p>Gaan uw activiteiten verder dan normaal vermogensbeheer en vormen zij fiscaal een bron van inkomen, dan kan het resultaat in box 1 vallen als resultaat uit overige werkzaamheden of winst uit onderneming. De beoordeling hangt af van alle feiten en omstandigheden; het aantal transacties is niet het enige criterium.<\/p>\n<p>Binnen het huidige box 3-stelsel wordt in beginsel met forfaitaire rendementen gewerkt. Als u aan de voorwaarden voldoet, kunt u ook uw werkelijke rendement doorgeven. De <a href=\"https:\/\/www.belastingdienst.nl\/wps\/wcm\/connect\/nl\/box-3\/content\/wat-is-mijn-werkelijk-rendement\" rel=\"nofollow noopener\" target=\"_blank\">Belastingdienst<\/a> gebruikt dan het voor u voordeligste van het toepasselijke forfaitaire en werkelijke rendement.<\/p>\n<p>De grens tussen normaal vermogensbeheer en belastbaar inkomen in box 1 is niet strikt afgebakend. Onder meer de verrichte arbeid, het gebruik van bijzondere kennis en de objectieve verwachting dat daarmee extra voordeel wordt behaald, kunnen een rol spelen.<\/p>\n<p>Bewaar daarom rekeningoverzichten, transactiegegevens, stortingen, opnames en kosten.
